Local land charges

Update on local land charges

In accordance with HMRC ruling in December 2016, the London Borough of Camden, local land charges will start charging VAT (20%) on all Con29 search fees, from 31 March 2017.

LLC1 fees and EIR’s are outside the scope of VAT.

Please note, any searches comprising of Con29 received on or after 31 March 2017 with incorrect fees, will unfortunately be returned for additional extra fees.

What is a local land charge?

A local land charge is a restriction on a piece of land or property that can limit its use or be binding on successive owners.  It provides prospective purchasers with information about the property, such as conservation areas, tree preservation orders, conditional planning permissions, financial charges, miscellaneous charges, listed buildings and light obstructions notices.

Q. Why would I need to do a search? What is the difference between the five different searches?

If you are buying or leasing a property, you will want to know the details of all entries registered against it that fall within the definition of a Local Land Charge (LLC) e.g. expressly made a local land charge by statute or a charge which is a restriction or prohibition on a parcel of land securing payment or restricting use that is binding on successive owners.

There are 12 different parts of the LLC Register covering a wide range of areas. For more information please visit: www.llci.org

The CON29 enquiry form serves to provide prospective purchasers with information which relates to the property being searched and, in some cases, the area in which the property is situated. It provides information on items in existence, as well as items that are in the pipeline/being considered, and/or awaiting approval.

It is often these items that, without the CON29 enquiry form, would go unnoticed and have a material effect on the future use, development and enjoyment, as well as financial burden, of the property. Whilst some of the enquiries seem to replicate areas of the LLC Register, this is not the case, as the information revealed in response relates to notices or procedures prior to LLC Statutory Registration.

The vast majority of the information used to respond to the CON29 enquiries comes from within the local authority.

A CON29 enquiry form is completed by the local authority. A local authority-completed CON29 is backed by the local authority's insurance and is commonly referred to as an official CON29. Completion of the CON29 form is not a statutory function, but a contractual one upon payment of the required fee.
